An Australian man has filed a lawsuit against American Airlines claiming he was left with permanent injuries after he was seated next to two large passengers during a long-haul flight.

Michael Anthony Taylor, 67, claims airline staff refused to let him change seats on the flight from Sydney to Los Angeles, despite his desperate pleas to move.

Mr Taylor says he's since experienced aggravation of pre-existing scoliosis, a condition which causes the spine to curve out of shape. He is seeking more than $100,000 in damages.

Last week, American Airlines announced plans to reduce the space between some seats in economy class of its new Boeing 737 Max jetliners by 2 inches.

The lawyer also noted that Taylor's case falls under the Montreal Convention, which covers airline liability for passenger accidents.

The suit comes after the desperate man had pleaded with airlines attendants (haven't we all at some point of our flying careers...) to be moved to a different seat only to be refused.

Last year, an Italian lawyer sued Emirates airline after he was forced to "suffer" a nine-hour flight seated next to an obese man, the Telegraph of the United Kingdom reported.

The case, brought in Australia's Federal Court, follows a similar lawsuit past year in which an Italian lawyer sued Emirates airline after he was forced to "suffer" a nine-hour flight beside an obese man.

All 310 seats on the 77-300ER plane were occupied by other passengers during the December 28 flight.

Shine Lawyers transport law manager Thomas Janson said the claim had been filed under the Montreal Convention, an global treaty that governs passenger injury on worldwide flights. According to USA federal regulations, passengers are not allowed to sit in seats reserved for crew members. "There will be a huge outcry against the way airlines furnish their cabins, particularly in economy".

"I don't hold any malice towards the people in the seats next to me - they'd paid for a ticket too", he told Sydney's Daily Telegraph. Dao settled with United Airlines for an undisclosed amount on April 29.
