Supreme Court rejects appeal to reinstate North Carolina voter ID law

After the Shelby decision, North Carolina enacted strict photo ID requirements, slashed the early voting period to seven days, eliminated same-day voter registration and out-of-precinct voting, and ended pre-registration for 16-year-olds.

After a drawn-out legal battle, a federal appeals court in July 2016 struck down passages of the law that it said were meant to "target African Americans with nearly surgical precision".

The Justice Department filed a brief urging the Supreme Court not to take up the case just one day before Donald Trump was inaugurated as president.

In a statement that accompanied the court's order Monday, Chief Justice John Roberts pointed to uncertainty over who was authorized to file an appeal on behalf of the politically divided state.

The court's action sets no legal precedent, but it likely ends the litigation over the North Carolina law. An estimated 600,000 legitimate Texas voters lack the kind of ID the law mandates, and so would be prohibited from voting.

The state's new Democratic governor, Roy Cooper, and its Democratic attorney general, Josh Stein, had told the justices they wanted to drop the state's appeal of the 4th Circuit ruling.

That was the case, the court said, even though the state had "failed to identify even a single individual who has ever been charged with committing in-person voter fraud in North Carolina".

Republicans had literally ordered data on which voting methods black voters used more than white voters, then eliminated those very methods. Other studies challenge the idea, claiming that voter ID laws do not lead to voter suppression.

Civil rights groups, including the National Association for the Advancement of Colored People (NAACP), and individual voters sued to block North Carolina's statute, saying it violated the U.S. Constitution's guarantee of equal protection under the law and provisions of a civil rights law called the Voting Rights Act.

Last July, a federal appeals court found the controversial law was created to "target African Americans with nearly surgical precision".

North Carolina's GOP Chairman Robin Hayes is confident the legislature will move "very quickly" to pass a new law that reflects the "monster" voting bill's premise.

The Rev. William Barber says in a news release that the victory is "unimaginably important for African-Americans, Latinos, all North Carolinians and the nation".

The Supreme Court on Monday declined to hear an appeal to reinstate North Carolina's controversial voter ID law.

North Carolina's General Assembly and Republican lawmakers tried to revive the case in arguments about whether the attorney general can dismiss the appeal, Roberts wrote in a two-page statement about why the court won't hear the case. The U.S. Court of Appeals for the 4th Circuit ruled that the changes to state election procedures were motivated by discriminatory intent, and the state asked the Supreme Court to weigh in late previous year.

But they were unable to find a necessary fifth vote from one of the court's four liberals.

Opponents of the law said it disproportionately affected African-Americans and was created to suppress their votes.
