In its petition, the party said that use of NOTA in "indirect elections" was in direct conflict with and militates against the system of proportional representation by means of single transferable vote.
"The system of NOTA makes the system of proportional representation by means of single transferable vote nugatory and otiose and can not be made applicable in Rajya Sabha elections", the petition added. On July 26 Patel filed his nomination in Ahmedabad to the political secretary of party President Sonia Gandhi. The report quoted sources as saying that at least three MLAs are insisting on returning to Gujarat to participate in relief work in their constituencies, while others are said to have had an altercation with their group leader and AICC secretary, Naresh Raval.
The order comes amid the recent report of the Congress transporting 42 of its members to Bengaluru on Friday against alleged attempts of "horse-trading" by the BJP.
An even bigger problem is that if the BJP's accusations are true, then both the Congress and the BJP in Gujarat have MLAs who can be easily influenced with bribes. The defiant voter can continue to be an MLA and his vote can also not be invalidated for defying party directions, the EC rules say. He said the BJP was "plotting" to steal Congress MLAs from the airport itself. "While they were imparted basic lessons on voting pattern and cross voting and other issues, they were also coached on the strategies to be adopted for the next elections and how to connect with the common man and social functionaries", D.K. Suresh, Bengaluru Rural MP, told The Hindu.
To stop the election of Ahmed Patel, BJP is now banking upon the NOTA provision. Sharma added that only Parliament could legislate such an amendment to apply NOTA to RS polls as well (it's applicable to Lok Sabha polls). Congress members trooped in to the Well of the House raising anti-government slogans, which were matched by counter- sloganeering by the BJP benches. They asked the Commission to constitute a high powered committee to enquire into the charges of money and muscle power to engineer defection of Congress MLAs. "It is also shocking to note that even the official machinery of the state is being used to foster political purposes, as is evident by the conduct of N.K. Amin and S.P. Tapi", the party charged. However, rumours have it that signs of dissent are loud and strong among the 44 MLAs lodged away in Bengaluru. But with Rajput, Tejashree Patel and Prahlad Patel resigning on July 27 and Ramsinh Parmar, Mansingh Chouhan and Chhanabhai Chaudhary a day later, the Congress has been left ruing its prospects.
